Surely you can't be held responsible for this?! If you are out at work all day, then it can't be your fault if the wind blows it into the road - if people were a bit more friendly, they'd pick it up and move it for you like I have done in the past when driving.

I really wouldn't worry - if someone were to hit it then the must be a really sh*t driver! God, if they hit a wheelie bin, what would happen if a person had collapsed in the road!

What difference does it make? But it's your responsibilty, your bin your problem. the Binmen are there to empty it and put it back they can't be blamed for the wind blowing it over!

It would be your resposibility as the binmen have already emptied the bin its your responsibility to put the bin back on your propery not leave it there.

I recon you would be, for not putting it safe after collection. But lets be honest, people who go out to work, the elderly, are they about and able when the bin is emptied to secure it strait away, I don't think so. In my street we all try to work together, and place bins after collection in a secure place. As an early morning and night driver, I many a time come across wheelie bins in the road, I just lay them down at the side of the road.

If indeed it is windy and the bin in blown into the street and hit. It is considered an act of God. A sensible garbage collector would lay the bin on its side if the wind is blowing but if he does not then he may not be liable. If the bin has been left out beyond the collection day then you could be liable.

I wouldn't really say it was your fault, you didn't put it back on the path! Its just the wind. You cant stop it!
