If someone crosses the street and gets hit by a Model-A what insurance will cover it?

Should the pedestrian who broke her hip go after her health insurance first or the car insurance of the motorist who hit her? Do they pay it 50/50 or what?

the drivers car insurance will pay both, and if exhausted, the driver becomes liable for the rest

the motorist if he has insurance if not she will have to get her insurance to pay first and then try to collect and pay back the insurance . if they have insurance it should cover her pain and suffering also ...have to sue...for that unless they want to settle with her

Well with any sustained injury health insurance automatically pays for it so that's already fixed. If a pedestrian is struck by another vehicle then the person driving the vehicle is liable and should have their own insurance pay for the damages. This is a touchy situation because at times out of these cases lawsuits can emerge costing the driver more money. The driver is responsible in the collision of a pedestrian and the insurance is immediately billed. Also it is important to file a police report at the scene so no one walks away with the possibility of fraud being committed.
