If there is alcohol in the trunk of your friends car and it is closed, and you are in the backseat....?

and get pulled over by a cop and he finds it unopened with all 18 year olds in the car, what can possibly happen?
Also what could happen if its closed in the back seat.

There are a lot of people on this board who seem to be under the impression that you would be fine as long as it's not open. This is a perfect example of why your better off doing your own research in legal matters, because other people who haven't done the research either will tell you what they THINK, and what they think is usually wrong. But they won't get arrested for giving you bad advice; you however, can be arrested and have your license suspended for illegal transportation of alcohol.

Whether it's in the trunk or the back seat, you are only 18 years old and unless someone's mother or legal guardian happens to be in the vehicle as well, this is 'illegal transportation of alcohol by a minor' and it's almost as bad as a DUI. If you are the driver you will most likely also be charged with possession of alcohol by a minor as well.

As long as your friends are sober, they won't get in any trouble, and the cop will probably let one of them drive your car home while they handcuff you and put you in the back of the squad car, while all your friends are standing there looking dumb and mumbling 'sorry dude, I thought we couldn't get in trouble for it'. They'll take you in to fingerprint you and put you through all that fun stuff. In most states, alcohol offenses while driving are automatic grounds for an on the spot arrest.

Whatever you do, please for the love of God DO NOT listen to Country Boy or any of the other people telling you it's okay. People who just say random stuff like that are the kind of people that will get you screwed every single time. You are not of legal age to possess or consume alcohol and therefore cannot transport it in your vehicle no matter what! The following is an excerpt from the Illinois website that defines the offense and the mandatory punishments:

"If a person who is under 21 years of age at the time of arrest is convicted of illegal transportation of alcohol by a driver, the Department shall suspend his/her driving privileges for 12 months."

That's a MANDATORY 12 months. A year with no drivers license is no fun, trust me, I know all this info because me and about a half dozen other people I know used to party our asses off and yes I've been cited for transportation but I beat it in court (with an outrageously expensive lawyer) because I was sober and the cop only wanted to search my car because there was a bunch of 18 year olds in the car and for no other reason. I wouldn't consent to the search so he cuffed me and did it anyway and in court my lawyer successfully argued that the cop conducted an illegal search of my vehicle.

However my legal fees for that lawyer were in the neighborhood $15,500 and my parents made me pay back ALL OF IT. It's best not to risk it man just wait until you're 21.

it would depend on the legal age to buy booze where you are,may be charged with underage possesion of alchol, and if they find someone bought it for you then they can be charged with contributing to delinguence of minors

Friendly Stranger..
The police may fine you for it, but the most likely scenario is that they will confiscate the alcohol. If it is closed then they can't exactly get you for it because it isn't open. So they will take it away to keep you from drinking it while driving. The only way they could prove that you were drinking would be to conduct a sobriety test. But also know it is illegal for 18 year old individuals to purchase alcohol, so you could be fined for it.

If the alcohol is in the trunk nothing will happen. If it is in the interior of the vehicle and is unopened, it would be up to the officer what action if any would be taken.

UCANTCME
You will be ticketed for what is called a "MIP" Minor in Possession and you could go to jail depending on where you live.

You said the magic word. If indeed none of the bottles have been opened you're all in the clear no matter where the bottles are located in the car.

Don't for gosh sakes ever crack one in a car off the car's private property.
