If you are hit by a car in a crosswalk but don't have the 'walk' light, who is at fault?

If a man is hit by a car while going across the crosswalk without the signal to do so, is the driver of the car or the man who crossed the street at fault?

the walker is at fault. it is much easier to control your body than it is a one ton car which cannot stop on a dime. you just cannot always put the complete burden on the car driver

The man who crossed the street.That walk signal is there for a reason.Then again the driver should have been playing more attention.Really idk go figure though its more of the man's fault

You are at fault here. Its the same as a driver running a red light if you try to cross without the 'walk' signal.

The fact the crosswalk is also controled by a "walk/don't walk" light put the pedestrian in the wrong for crossing against the light...If the light was not there but a marked crosswalk was then the rules change and the driver is suppose to yield to the pedestrian as long as the pedestrian isn't crossing against the traffic signal.......

The pedestrian is at fault since he is authorized to cross only when the green signal with pedestrian sign is on. But the driver has to be alert all the time because if it happens to be a cylinder conaining LPG then BOOOOOOOOOOOOMMM.

The person crossing is at fault, then again he is supposed to yield to pedestrians. I would say that the person crossing should be to blame , dont they know how to read the traffic signals?

They're always going to go after the person in the car who hit the person pretty much no matter the case. It's just how America is.

i think it would depend on if the driver ran a red light. but i dont think either would be at fault unless they had proof the ligh was red or the walker didnt nhave the signal o cross but im just guessing haha.

The pedestrian always has the right of way. Automobile drivers are required to have their automobile under their control at all times.

There are accidents where someone "darts out" in front of a car, and that is certainly unavoidable. But even then the driver can be charged for involuntary vehicular homicide.

Both! The walker for J walking and causing a accident. And the driver for not yearling to the the person walk. And clearing the cross walk.
