If you get into an accident where you are not at fault, but you have been drinking, are you at fault?

I was just wondering, if you are over the legal limit?

obviously your going to get a ticket er something cuz you were intoxicated while driving=illegal

You will be assessed with part of the blame due to drinking and driving as well as a ticket for the same.

if you are over the legal limit then the police would probably see you as part of the problem as you would be the 1 involved in the accident.now it all comes down to whether you have got a decent clean liscence or known to the police for that sorta thing.if the incident was serious then obviously with a good liscence they may be easier on you but if you were a bit naughty and lots of points plus lots of bans where in your possesion then they may hit you a bit harder.so be good dnt drink and drive

Generally speaking if you've been drinking you are at fault no matter who caused the accident. That is the position most law enforcement officers take. It is extremely difficult to prove that the incident would not have happened if you were 100% sober.

you shouldn't be driving if you're intoxicated. even if a person pulls out infront of you, you are still at fault. you can get large fines, a DUI, and possibly jail time, lawsutis for a death. etc.

Not likely, but you will, however get the ticket for DWI, and that doesn't look good on the insurance. Couple with that that in most states you can be still held liable for damages, your insurance wouldn't like that one bit. The lesson here: Don't drink and drive. I mean, really... call a cab or get a SOBER friend to drive you home.

Most likely you will get a DUI. The fact that the accident was caused by someone else is one issue. The second issue is that you were driving a car at or over the legal limit (.08) or while impaired. Here in Arizona, if you can be proven to have been driving while impaired by alcohol, drugs, etc, you will get charged with a DUI.

If the police officer suspected you were drunk and gave you a sobriety test and you blew over the legal limit yes you are. The court will reason that you shouldn't have been driving while drunk in the first place.

Then you will go to jail for DUI but the accident will be paid by the other driver

It's pretty easy for the insurance companies to blame the accident on the drunk driver. I wouldn't want to be in that position!

In the UK, under that theory that you should not have been there driving drunk, you will be held accountable for the accident. I had a troop that was just over the limit in the UK who was hit in the rear at a stop light. Had he been sober, he would have been home free. However, he was held 90% responsible for the accident since he was driving drunk and should not have been there in the first place.

And as he was drunk, his insurance was void so he had to pay the costs of repairing both vehicles out of pocket -- all of his car and 90% of the other driver's.

You should NEVER drink and driveWhat insurence company is going to side witha drunk driver? In my opinion, the drunk was as fault.

yes you are, for DWI (driving while intoxicated)

it would be the same charges as if one was pulled over by a police officer.

I do not know about all states but in Oregon if you are over the legal limit you can be held liable even if the accident was not your fault. You should not have been behind the wheel is their justification.
