depends on what state you live in. for example in WA.state its a misdemeanor and in OR. it`s a felony. please don`t find out the hard way be smarter than me. |

It's not always a felony. We don't have 'felonies' in our state, and it really can't be classified until you are convicted. In my state, it's a motor vehicle violation. In PA, a DWI trial is held in front of jury - so it really depends upon the law in your state. |

I might very state to state but I know that in Missouri it's a misdemeanor the first two times but after the third DUI it's a felony. |

the difference between a felony and a misdemor is that a felony is serving more than 1 year in prison and a misdemeanor is serving less than 1 year in prison or jail.You wouldnt serve more than 1 year in prison for drinking and driving unless you killed someone while driving intoxicated....this would be negligence or manslaughter i cant remember which one |

In the U.S. one is a misdemeanor. It depends on which state you live in on how many DUIs it takes for a felony. If you have even one, you are not allowed into Canada, as it is a felony there. |

A felony. Think about it, lets say you took a shotgun in a place full of people and you went duck hunting with it and started shooting with people in your line of fire.
Would you consider that a misdemeanor? |
