The car illegally parked is not responsible at all, as it was stationary. If it was obvious it was there then it wasn't your husbands place to punish them for breaking the law, and the offence is punishable by a fine, not having their car smashed up!!! I'm afraid he'll lose that argument unless he can say it was incorrectly parked and rolled into him due to lack of sufficient holding brakes. |

Makes no difference that the other car was parked illegally. You should still have seen it. As it happens, the police aren't going to be terribly interested, you just need to sort it out like any other bump. |
