The confusion may in fact be a result of the states changing their laws all of the time. However, based on some sources, I think the "legal limit" for blood alcohol content may be .08 in every state in the union.

It's clearly outdated and may lead one to believe that there is no legal limit in Mass. But I know for a fact that Ohio is wrong, because the legal limit here is .08.

It's pretty well done I think and includes penalties. If you take it at face value, every state is indeed .08.
Once upon a time it may have been true that some states had no set limit, but doesn't appear to be anymore.
Edit: Well said, Misha. It is legal to drink and drive so long as you are not over the limit and can pass field sobriety tests if stopped. |

Only if murdering people is illegal in the state as well.
As for variations on the BAC level:
If you are pulled over for speeding or other moving violations and you have ANY amount of alcohol in your system, even if it is under the 'legal' limit, you can be charged with reckless driving while under the influence.
Same goes for being in an accident regardless of whether or not there are any injuries.
If the alcohol in your system is affecting your driving ability, even if it's under the legal limit, you are too inebriated to be driving and it is irresponsible to get behind the wheel. |

They set a limit of what your blood alchol level can be. For example PA is .08 if you have 1 beer you will not be at the limit. So to answer your question yes you can drink and drive but you can't get hammered and drive |

Yes it is illegal in all 50 states and the Distric of Columbia. It is a law that the federal government instituted but allow the states to determine the proper punishment. All states have a BAC of .1 or lower as legal limit. For example KS is .08 WA is .08 South Carolina is .1 |

I don't know if you're in the US or not but by your question, it sounds like you are. There is a US question board you know..
Anyway, all states might have different alcohol levels allowed but it's illegal in all of them to be driving over that given limit. And if you're going to be driving, you really shouldn't be drinking ANYTHING. Even if you're in an accident and you're not over the limit, you lose all your rights. It's just not worth it, it's irresponsible, careless and selfish. |

What is illegal, is drinking TOO MUCH and driving. And how much is too much differs from state to state. |

It is illegal in all states, but some states have a different level before you are considered intoxicated. In Washington State it is 0.8. |

The only state it is LEGAL to drink & drive is the STATE OF INTOXICATION. The only think that is different is the limit. In some states it is .08 (somebody please correct me if I am wrong here) while others it is a .10.
If you want to drink and drive then you should be thrown in jail and and charged with attempted vehicle manslaughter -- one charge PER aresting officer. |

I think there is no open container law in texas.
but it is illegal to be driving drunk anywhere in the us. The limits of that are different from state
