If a car has five seats, but only 4 seat belts, is it illegal for a 5th person to ride in the car? The laws I've checked state that if a seatbelt is available, it must be worn. But what if one isn't available?

In California, the law reads that every occupant in the car must be belted in. So, in your scenario, no matter how many seats are in the car, only four people can ride because there are only four sets of seatbelts. |

Where I learned to drive the law stated it just the same way and I remember in driver's ED the instructor said that the person not wearing a seat belt could not be ticketed as long as all the available seat belts were used. However there may be another law that the police officer could apply to the person not wearing the seat belt or depending on how over crowed the car is it could maybe be classed as dangerous driving since it is harder to operate an over loaded car. |

In missouri they cannot pull you over for not wearing a seatbelt, but if they pull you over for any other reason, anyone in the car not wearing a belt you can be ticketed for. Depending on your car, sometime the fifth belt falls down under the seat cushions. Especially SUVs. |

Check behind the seat cushions and make sure it has not slide there if it there you have to have them on. You do not want a officer finding them for you. |

It's not illegal but it's dangerous. If you live in New Hampshire, they don't even have a seat belt law. |
