actually top contributor it IS illegal...someone i know lost her license for simply sitting in the car with her keys whilst drunk. She didn't even attempt to leave her drive. |

Hi dakota if you fall asleep in the vehicle drunk/over the limit & the police find you then you can actually be charged with being drunk in charge of the vehicle so your moms right it is not legal to do so ... sly |

Patrick W, is unfortunately, WRONG. Even if you are in the back seat, you are in possession of the keys therefor you are in control of the vehicle. People are charged regularly on that basis, in pretty much every city, state, and province.
That being said, some charges do get tossed for people in the back seat, but, seriously, you can't count on it. After the ticket is issued, if you plead not guilty, the judge will make a ruling based on intent. |

It's illegal, you would be done for being in charge of a motor vehicle while under the influence of alcohol. |

i believe if you are in the backsear and the car is parked and off you are not breaking any law. The laws may be different for each state however if you were in the driver's sear you would be convicted no matter what because there is intention to operate the vehicle. The backseat leaves doubt and does not break any laws,, just as if you were in the driver's seat without key's you'd be safe. Tell mom she's wrong but better off not being in that situation. |

If you are in the car, drunk, and with the keys on your person you are in big trouble! Your mum is correct. If you are going to get in that state again, put your hand up under the wheel arch and sit your keys on top of a tyre, cannot be seen from the outside and they are no longer on your person or inside the car with you.. |

If you get drunk somewhere else and try to do anything associated with a car, you are a PUTZ and should be buried under the jail. |
