Just to reiterate what everyone above me has said- NO it is NOT legal & the driver can & should be cited for a child restraint violation, which is a $100 fine in my state. |

Plus, in the event of something like a head-on collision, the weight of the adult would crush and kill the child sitting in front of him.
That's why child restraint seats are designed the way they are. |

No it is absolutely not legal. The child needs to be in a car seat.
The seat belt over both of them can actually injure the child, if the adult got thrown forward the baby would get squashed between the adult and the seatbelt and could be killed from the force, get their neck broken if belt slipped, etc. But if they aren't behind a seat belt they would get thrown from the adults arms and probably thrown out of the vehicle in an accident. Neither situation is acceptable or safe- possibly very deadly.
There are some states that have laws that allow breast feeding babies to be out of the car seat to eat. But its never allowed to put them in a seat belt with an adult, you can't do two to a seat belt at any age legally. |

I do not know for sure that this would be illegal every where in the USA. I do know that this would be very hazardous to any baby or small child in an accident or if the car came to a sudden stop. If the person driving the vehicle can't afford a child safety seat someone may donate one if an ad was put in the paper. |

Everyone in a car has to be wearing a seat belt. A 12 month old should be in a car seat. If it is the driver's or the car owner's child it must be in a car seat, by law. If it is not the driver or the owners child, it must have a safety belt on by law.
And YES it IS ILLEGAL for two people to be in one seat belt. |
