No employer, so far as I am aware, can override your legal right to approach her and deal with her. Just keep everything in writing in a diary so that if they try to take action against you later for pursuing your legal right to approach this woman, you are covered. My advice is deal with her publicly and with reliable witnesses.

To my mind stopping you from taking action against her is a form of workplace harassment, and so long as you deal with her properly you can be covered against any claims that you harassed her: she has a legal obligation to you and cannot hide behind her employer

Your employer may request that you do not approach them in the workplace. That is the employers right. However, outside of work you may approach this person at any time you desire. That is your right under civil law.

Sue her for the damage.

As you have video evidence you will win. I have no doubt that you will be able to claim costs as well.

This way you don't have to "approach" her, so you won't upset your employers. Let the law handle it, your lawyer can issue the writ.

Taking the case through the courts will also guarantee that you actually get your money as her wages can be garnered if she doesn't pay up.

There is no law which says you cannot confront someone who hit your car, at least no civil law. What else are you supposed to do anyway?
You pretty much have to approach them.

Your employer may have some work rule which does prevent you from instigating conflict with another fellow worker, but then it wasnt you who instigated the conflict, it was her.

I suggest you talk with your boss or supervisor and seek their advice, because you dont want to get into trouble by breaking one of their rules, so ask them how you are supposed to resolve this.

You reported the car's damage to your insurance company and its still gonna cost you $600? Thats a large deductible, how much total damage cost was done to your car?

If you do approach this person, and she doesnt have insurance as you think, you cant force her to pay for the damages, even if she does admit it was her fault. You could report this to the police and maybe they would give her a ticket for not having insurance and maybe she could get her license suspended, but they cant force her to pay for the damage either. You could take her to small claims court and sue her for the damages, but that would take years to resolve.

Start with your employer, see what they recommend. They too cannot force her to repay you, but maybe she would feel enough pressure about losing her job or not getting a promotion to want to do the right thing by you and keep in good graces with her boss, she may not want to jeopardize her employment by showing them her dishonesty.

Good Luck, this is a tricky situation, and sometimes there is just no way to remedy things, alot just depends on her wanting to do the right thing, and so far, it doesnt seem like she does.

Well, not that my opinion matters, but I would get a copy of the tape (tell them it's for your insurance) and take it straight to the sheriff or police and swear out a "citizen's arrest" citation for hit and run and driving without insurance.

Call the DMV and give them her tag number and tell them she has no insurance, there go her tags and license.

Then, walk right up to her with the sweetest smile you can come up with and say " Guess you picked the wrong car to hit, didn't you?"

Payback can be a beautiful thing.

Of course, if that doesn't work take a sledgehammer and trash her car.
