i work 10-12 hrs a day and am given no breaks. i drive feed delivery truck on most of the days and am paid from the time i clock in till i clock out.. i recently got wrote up for taking a 15 min break at a delivery site due to being so tired that i felt it is unsafe for me to drive. is this legal for them not to allow breaks or force dangerous work practices.. a semi in the nds of a tired driver is a very dangerous weapon... if it makes a differance i live in iowa... thanks

I would say NO,its illegal to work a person w/out a break of any kind.Contact OSHA and let them know whats going on hun.Thats the labor board and they can do something about it.....good luck!

Working a minimum of 6.5 hrs, the company is required by law to give you a 15 min break. Working 8.5 hrs, you are allowed 30 minutes, and nine or more hours, the company is required to give you one hour break.
Dispute the write-up with Human Resources in your company.
There is a maximum (for truck drivers) to work ten hours or 500 miles.

I am not sure of the legality - next time you get stopped at one of those check points -ask them.

In an 8 hour day you are entitled to two 15 minute breaks. Contact the DOT. They should take care of it for you. What company do you work for, they sound like a bunch of slave drivers. Keep all of these things documented in case of future problems.
