so if your accelerator stuck one day and the next week it stuck again and caused an accident would you get in trouble with the law because you did not get it checked out?

You CAN get into trouble if it was determined that you drove the car in an unsafe condition. The driver is responsible to maintain a vehicle in a safe mechanical condition.
Of course, a complex mechanical machine can unexpectedly break down. But a well maintained vehicle is les likely to. |

Well, if you knew that it was sticking, and did not do anything to fix it, you would be responsible for the accident. You knowingly drove an unsafe vehicle, and you knew it was not working properly, but you drove it anyway. |

Yes, there is a concept in the law known as "Notice"- this means that you have been made aware of the danger prior to the incident. Once the accelerator stuck you are considered "on notice" in the eyes of the court.

If you are involved in an accident and failed to report it, you could be cited by a policeman for violating some traffic law where you failed to appear in court, you could be fined or jailed or both for not correcting the problem(s) defined in the citation. |
