My airbags did not deploy in my head on collision, Can I SUE?

it was a 2005 dodge ram 1500 quad cab.. i did hit with the front i have pictures and according to the guy that did the estimate for the truck to repair he said that it was a bad crash for the airbags not to deploy. n plus some main part of the truck that runs along from front to back got bent an the truck is not repairable,
thats the link to the pic of my truck

Sue for medical bills, and pain and suffering.
It'll cost you more in lawyer fees than you'll get from the settlement. |

there are many factors that depend on whether the airbag will deploy. there will be a sensor on the front of the vehicle that indicated that it has been hit. as well as this the is a deceleration sensor built into the airbag control unit. in order for the airbags to deploy both these sensors need to be activated. airbag systems are not designed to be deployed in all impacts and it depends how the vehicle is hit. the chances of getting the upper hand in court are slim due to this.
sorry to see your truck in a mess, hope ur ok. at the end of the day that is the main thing.

What did you hit? As someone already mentioned, there are various forces involved with airbag deployment. From the looks of it, it seems you hit some type of vertical object such as a traffic sign since no damage to your headlights is present. Your appraiser doesn't seem to have much experience in accident forensics, but from the looks of your crash, your forces were directed toward the center and above the front and to the right of the bumper. Those forces lessened the full impact to both the bumper support assemblies. this would have prevented the air bags from deploying. Also, it appears that you were traveling less than 35 miles per hour. i could tell more if i looked at your truck on a lift. Suing would be a waste of time and money. |
