My flatmate was caught driving my car with two tyres under the legal limit?

Whats going to happen to me? I let him drive the car

He has his own insurance policy on the car, it's just the tyres

3 points for each illegal tyre and 60 fine for each.

It is the driver who is responsible not the registered keeper.

Hi john right to start off with nothing should happen to you as you wasnt driving the vehicle at the time ! your flatmate will be the 1 that suffers depending what the police have done i.e reported him then the chances are your flatmate may well find that he will get 6 points on his liscence i.e 3 points per tyre ! even though its your vehicle it was down to your flatmate to check the vehicle is roadworthy before he drove it ... hope this helps

Driver may be prosecuted for this offence, but sometimes the police issue a ticket that allows the owner/driver to rectify the faulty unit(s) and show evidence that it has been done, and then they will take no further action.

if you are lucky and you are dealing with a police officer not doing his job properly,,,then nothing,,,
if the police officer is doing his job properly then you as "OWNER"are responsible for any offences committed,bald tyres etc,,you are,as owner,ARE AIDING AND ABETTING his offences also responsible for any parking tickets,,,driving or not.
unfortunately not many police officers today ,are doing their , job properly as they have been "TERRIFIED"out of doing their job by the threat of dismissal by offending someones rights.

I would of thought nothing to you since you were not driving at the time i assume your friend had DOC otherwise there's the not insured part. Since you weren't driving you can argue they were fine last time you drove and since you were not driving they can't really do much.
your friend could face a fine and points.

Your flat mate should be fined for driving an unroadworthy vehicle, and a driving prohibition notice should have been stuck on the car requiring the tyres to be replaced before it is driven again.
That's what would happen in Australia or other civilised countries.

Even though it is your responsibility for the tyres, HE was the one driving so he will get the fine and the points. He could put in a claim for lack of due diligence if he feels that the tyres were down to you but I shouldn't think it will go that far.
It could become a test of friendship now, however

Your mate could receive 3 points per tyre on their licence, plus a potential fine of £1000 per tyre, depends if it is taken to court, & if the magistrates have been having a bad day!

As long as he was insured he'll end up with three points and a fine, you'll be ok.

If he wasn't insured & you agreed to let your flatmate drive your car then you are screwed!

Although your the owner,the driver is responsible at the time the cars been driven, he will defo get 6 points for the tyres plus a fine, your not going to be involved ok.

it's your responsibility, they may put you in prison for 100 years or fine you, maybe points on your licence as well, because it makes your insurance void

You're responsible for the car and your insurance policy. Simple as.

He's responsible for his driving and making sure he has a valid license.
