my mom was backing out of a parking space at a mall. there is enough room for two cars to pass each other down the aisle. the issue is the person who hit her was backing down the aisle, and not looking (admittedly). who is at fault?? why??

i'ight man its pretty simple your mom was backing out of a parking spot was the other car backing down a one or a two way row if i one way that other car is at fault if i two way really they are still at fault due to the fact that they were backing against the flow of traffic if you mom was found at fault i would fight it to the core i mean really the person in the other car was not watching there fault i mean i had another truck back into me when i was pulling out a spot its kind of a who hit who kind of situation when your backing |

I wouldnt exactly say it was your mothers fault, unless she wasn't looking where she was going and she happened to back into the person behind her. The person who was backing down the aisle is a moron, he/she should have just kept driving and either found another parking place, or drove around in a circle to go back to the one they were initially going for. Sh|t happens yo, hope your mom is okay. |

I thik your mother is. The car in the aisle has the right of way, she was entering the aisle, so she has to yield to cars in the aisle. |

I think it's both drivers fault with the majority of fault being with the driver going backwards down the aisle. If the other driver was going forward, he/she would have seen your mom backing out. Part of it depends on how fast your mom backed out. If she was slow and cautious, then 95% of the cause is the other drivers. |

I think it's the other person's fault because the other person was "backing down the aisle." When was this legal to drive backwards? It wouldn't be on a normal road, so I assume a parking lot may follow similar rules...... you should call a lawyer, they won't charge you to talk over the phone. |

more than likely neither one will be cited for being in the wrong as it happened in a private parking lot and each insurance company will have to pay for their client's damage. |

Sometimes I heard there is a no fault clause in parking lots. But it seems if from what I got from your question was your mom was backing up first. Then someone started to back up, and hit her. She wouldn't be at fault. She was first. |
