Thanks - oh we are in the UK Additional Details Thanks for that - my mother is not a numskull - she pays her council tax like any other person - which covers roads being gritted!!!??? - Where she left her house the road was not icy - it was when she entered a bus route - 3 days after it had been icy conditions - thinking that they'd have gritted the roads as the gritter had gone past on another road the night before! So she has every right to make a claim - oh and i have reported you!

Legally...not a chance.
1. There are probably NO official records of the accident (police or ambulance report of incident)...could have happened anywhere at any time.
2. Cyclist should be very aware of the road conditions and expect hazardous conditions...I used to cycle over 8000 miles a year and came off a few times due to diesel spills on wet roads or 'SMIDSYs' (Sorry Mate I Didn't See You)
3. If she were a MOTORcyclist or CAR driver...there would be no claim against the council. Also, if a pedestrian falls crossing the road...nto the councils fault.
4. Get real...you have as much hope of a sucessful claim as I would if I walked into a lampost with my eyes shut... |

What kind of numbskull tries to ride a bike on an icy road? And then has the nerve to try and get money out of the council. Come on, don't you think that your mum should have thought "hmm its a bit icy, it would be better if got off my bike and pushed or, better still get the bus!!!!" Why not take responsibility for her own actions. She made a mistake. Got to be a lesson in there somewhere.

Sorry, but my opinion is simple. Anybody who rides a bike in icy conditions is a candidate for a Darwin Award, or at least a volunteer speed bump. I am 60 years old. I learned when I was 8 not to ride a 2-wheeled vehicle with skinny tires on ice. If she had fallen in front of a truck or a bus, she would likely be dead, or seriously injured.
I am not saying she is stupid, but I am saying riding a bike on ice is a stupid thing to do. |

I am sorry to hear that your mother was injured. However I hope that your claim is not upheld. Your mother seemed to assume certain things that were not apparent.
I think your mother should invest in a Highway Code and allow the money that she wishes to claim to be spent on more important issues.
Department of Transport Official Highway Code 2007 Edition, Page 41, Rule 125, ".....Driving (this includes riding) at speeds too fast for the road and traffic conditions is dangerous. You should always reduce your speed when... (c) ..weather conditions make it safer to do so....."
If she were more attentive she would not have been injured.
Also, a bus driver should slow down to maintain control. See above again

Sorry about your mum. However "thinking that they'd have gritted the roads as the gritter had gone past on another road the night before" was a rash assumption. Mum was riding the bike, it's her responsibility to check the condition of the road she was riding over. You're welcome to try claiming, but I suspect I know what the Council's insurers will say. |

You can write to everyone from the mayor to the city works department and you wont get anything from anybody.
The city is exempt from any types of accidents like this and it was in reality not never the cities fault that this happened. |

As far as a claim, you should be within your legal right to do so, especially if that particular road fell under the jurisdiction of the city or township. Then they are responsible for her injuries.
I don't know who you would write to in the UK, but here in the States, we would hire the services of an attorney after first seeing a doctor in order to have documentation of the accident.
