Not injured in a car crash can i sue?

So today I was going to work on a 2 lane hwy...... I went around a corner going northbound and 2 trucks were passing me going southbound. The 2nd truck was towing a jobsite concrete mixer, he didnt have it hitched correctly and the safety chains were not hooked up, It then proceded to de-latch and head to my lane, I took it head on totaling my company truck. I walked away a little sore but no major injuries. I just want to know if there is any viabke way to make it a case because I was told by police and EMT i was lucky to have my life still.

You weren't hurt, so what would be the point of suing? To "punish" the truck driver? If he was driving a company truck, it's likely he's already being held accountable by his employer, and could possibly lose his job over this. |

you can sue for missing days @ work, like when my dad got into an accident, his car was in the body shop for over 5 months, he sued for those days he missed and the rental car. |

and if that was today then believe me that the reality of it all will be "felt" tomorrow for sure.
dont be surprised, youll feel it all over. pay a visit to you lawyers office and get all your answers straight from the horses mouth & make sure you go and get checked out if you feel too sore ; ) |

What to do?

Give yourself a few days to see how you feel. If you're OK, count your blessings!! The whole idea of a lawsuit is to get money for your losses. You don't won the work truck, do you? You didn't lose time from work, did you? You don't have any injuries, do you? If the answers are all no, you have no losses to be compensated for. In legal terms, you have no cause for action. |

Almost being killed is not grounds for a lawsuit. If you were almost killed, then you almost had a reason to sue.
It may be possible to sue for some or all of the following:
1. Damage to the truck that you were driving.
2. Charges for the services of the EMT
3. Emotional distress
4. Medical bills for determining whether you were injured (including x-rays, CAT scans, etc.)
5. Lost wages if unable to work while "a little sore"

No. You cannot sue for this. The thing is that you were not hurt in the accident. You have nothing to sue this person over if you are not injured in the accident. Now there is an issue of who was at fault in this accident. If the person driving the truck was at fault then they will have to pay for the damages with their insurance. If you were at fault then you would have to pay for damages. But suing in this situation would be a waste of time if you weren't hurt. |

I had a similar experience, where I was involved in a collision that wasn't my fault. Luckily I'm okay, but the same can't be said about my car. It wasn't even 3 years old, and it got written off. I'm only gonna get 10 grand (if I'm lucky) from insurance, but I paid 22 grand for it, and should have been able to drive it for many more years. That's quite a loss for me. Even though I'm thankful to be healthy, I wish I could sue because now I can't afford a good vehicle. |
