Ok so i traded my car with another person and the car i got is unsafe to drive?

i hope some one can help me i traded my 1994 mustang gt for a 1993 chevrolet truck and this is the problem i have we traded vehicles and i go and bring it up to get registered upon driving to the dmv the battery came loose resulting in destroying the fan i fixed it for $326 i got the car registered and then i brought it up to my local shop to get the oil change and have every thing looked over and found out there is a 3 in crack in the transmission and the rear brakes are totally shot along with a piece falling off for the emergency brake is there any way i can bring him to court and get at least half of the repair cost to fix everything due to the neglectful actions of him not telling me about the rear brakes, transmission and the battery i could have gotten in a serious accident and injured other driver

I doubt the courts will make the other owner pay for ANYTHING. The terms of most used car trasactions is that the vehicles are sold "as-is," and it is the new owner's responisibility to know what he is buying.

Did you offer any kind of warranty that the car you traded to HIM will be in any kind of perfect condition? Frankly, the only thing I can say is that you should have inspected the car before the trade. That's the way it should be for ANY used car transaction.

the question is did you ask about the condittion of the car before you got it. if you didnt there is nothing the judge could really do for you. another question the judge may ask is if you wrote up a contract based on the condition of the cars traded. the other person could very well say that you knew the car was messed up prior to the trade. if you have no proof then you have nothing. its always important to have a contract or something saying you were completely oblivious. if you have none of this then there is really nothing you can do. sorry

You are stuck you should have taken the car to a mechanic first and had him do a safety check he would of found the problems and told you then not to do it. When you buy a second hand car even from a dealer it is as is no warranty but try talking to the guy he may have not known of the tyranny crack and that can be inexpensively fixed and the the brakes will cost about $150.00 for both sides including turning the drums, ask him to pay half, the fact you did not check to see if the battery was tight is your fault so you won't get anything from him. If he is not willing to help fix the car take him to small claims court they may make him pay half, it's hard to say, if you can prove he knew it before he sold it to you he could get in trouble in some states and have to pay for part of the repairs.

Why didnt you take the truck to have it looked at prior to the trade, now your stuck.

If the seller makes no warranty claims to you then this is called an "AS-IS" sale and as bad as it sounds, you get what you paid for.

If you can prove that the seller knew about these problems then you might be able to take the seller to small claims court but this will be very difficult.
