If you are driving down the right side if the road, and a pedestrian is crossing the left side, but you can make it across before he or she reaches the yellow line in the middle of the road, should you go, or should you stop and wait for them to get across? And, there is no crosswalk.

In California, technically every intersection has an "assumed" crosswalk, whether it is marked or not. There are a few exceptions, such as where there are signs prohibiting pedestrians from crossing, or where the road way is divided by a barrier with out a pedestiran break.
So, if your scenario was happening in my state, technically, that pedestrain WAS in a crosswalk, and not jaywalking moment he stepped off of the curb. You should stop, and NOT try to race him to the yellow dividing line. |

The general rule is cars yield to pedestrians (not always true in the real world) but the pedestrian is technically jay walking. |

If there is no crosswalk, then the person is jaywalking, so if you hit them it is their fault for being in the road and not in a crosswalk. But the law says that if they are within one lane of traffic to you then you have to wait |

If you see someone crossing the road you are required to stop and allow them to cross even if their is no marked crosswalk. (sometimes there are no crosswalks) You should also watch for cars approaching from both directions and be prepared to warn them of the pedestrian. I have stopped for people in crosswalks and seen drivers approaching in the next lane nearly hit them. ADDED...Thumbs down? Come on people. Get a clue. Maybe you need to go back to drivers school. |
