Pls help, CAR ACCIDENT...A driver crashed into my car, I was not in the car but he stopped and gave me his?

details, I have a witness and I took pictures of damage of mine and his car. My car has been inspected and is a write off. 9 months on the claim is still ongoing, I am on thirdparty, fire and theft and have had a courtesy car since. The person is not reporting this incident, I have also been to his home address and his sisters are saying he no longer lives there but neighbours say they see him regularly. Im distressed because my car is onfinance and is now a write off and will I be liable for the courtesy car costs..I never asked fo the vehicle I was given the vehicle because my own car is a write off, please give advise,I have not even reported it to the police which I know I should have done ages ago, please let me know what you think will happen.all advise appreciated.

Raise a claim with the Small Claims Court asap, Did you report the accident to YOUR insurance company? within 24 hours as is normally required on your policy.

Go to the police if the other driver is refusing to report the accident.

not sure about the police as they do not usually get involved unless someone is injured.

Ok, you need to report it to the police asap, also, was he insured? Is he admitting liability? If so then his insurance company should pay for all the costs you have incurred, the total loss payment for the write off will be made directly to the finance company.

had a similar problem, report it to the police, they have to deal with it.

Also your insurance company should be investigating it, if he fails to admit who was driving it is assumed to be the policy holder. As you have an independant witness yo would be succesful If you were to go down the small claims court route but again this should all be taken care of by your insurance company.

basically your insurance company are at fault I rang a senior member of staff 3 times a day to get mine dealt with, if you don't push nothing will happen. Keep details of every call in a diary, note who you spoke to, what they said they would do and when they will contact you with the results. it does make them hurry up

You should have reported it to the Police at the outset. Any car accident....report it!! That's a MUST. I suggest you do so now so they can chase the man concerned - maybe for dangerous driving etc. They will want copies of your photos and details of your witness. Sounds like you have a good case. They might be able to give you some general advice too about how you and he stand legally. Your insurance company's claims department should be able to advise you about the courtesy car. If your insurance policy didn't allow you a courtesy car then you wouldn't have been given one for free. If you are going to have to pay for it ask them why did they insist on you having one? However, I suspect that you ARE entitled to this vehicle so don't worry. If you are still concerned after a talk with them, I'd also suggest you visit the Citizen's Advice Bureau to find out what you can do about claiming your expenses off this other driver. I do hope he was insured. Your company should be talking to HIS insurance company about the claim right now. Ask them how it's coming along and why it is taking so long. You shouldn't go to his house and hassle his family though. That will do no good at all. Your own insurance company are the best people to talk to first of all.

You should call your insurance company and let them handle this for you but if you have had the car for over 30 days you will be responsible for all of the additional charges at this time and those charges will be deducted from the total that the insurance will give you.

If you do not have GAP Will will only receive the (ACV) actual cash value at the time of the accident with the help of your witness.

But also in the law there is a term called "mediate" and that means that you should have done what ever needed to be done to take care of this accident and not keep the rental car for this long, the insurance company can only make you whole again and not better off then the accident.
