Ok.. details: There is a car (Jimmy) in the left turning lane waiting for the go ahead but decides to take a right instead to go to a gas station on the corner. Now, from this intersection about 1/4 of a mile back there is an overpass (like over a highway) so the driver in the car can't see anything coming until the vehicle is on top of the hill coming down. They look to see if there are cars coming.. assuming they don't see anything they proceed to the right when all of a sudden they are hit in the passenger side door by a small pickup. According to an insurance guy, he stated the pickup hit the car going about 40 mph. No police were called (not sure why.. which I'm is why I'm asking this). According to the info I provided, who would possibly be at fault?

right.. the jimmy was waiting for green arrow so he could go left but changed his mind (he was running out of gas) and started to turn right (across two lanes) to get to the store. It was my brother in law in the Jimmy; he stated the other driver was speeding around 70-75 which is why he didn't see right away. He is wanting to sue but I don't think he's going to make out very well with that.

I am a little confused by your details but it sounds like a person was going to turn left but decided to go to the right and changed lanes into an oncoming pick-up. Right?

No question about it. The guy making a right turn from the left turning lane is the cause of the wreck. The driver of the pickup did nothing wrong except for not getting the police involved. ALWAYS get an accident report from a law enforcement official. |

Jimmy is at fault. Was in a similar accident myself, driver was turning left, I was coming up behind, he decided to turn right into (of all things, a gas station) and hit me in the driver side front quarterpanel. Police were called, he was cited, and after 8 months of insurance going to court over it, they paid for all of my damages. |

definitely the person in the car who was switching lanes. he basically cut the pickup truck off. when anyone is switching lanes, it's their responsibility to make sure there are no cars in that lane before the proceed. even if he couldn't see well because of the overpass, the car is still at fault. |

When you are turning left in a left turn lane, you are not permitted to change your mind and turn right. Jimmy should have finished his left turn and drove to a safe place turned around and approched the intersection again with a definite plan of action. |

Jimmy is at fault. When you are in a left turn lane at an intersection, you can't cross over 2 lanes of traffic to turn right. He should have as Don said made the left turn, turned around and came back or went to a different gas station that wouldn't of required him of making an illegal turn. And that's what Jimmy did, an improper turn. |

Switching lanes at an intersection is illegal. Can it be proven that the other driver was driving at high speed? The illegal lane change is evident due to the accident. The police should have been called to determine what happened at that time. |
