Re Wheelie Bin? What I meant was if it goes into the road after the binmen & hits a car or cycilist et?

I live in the country & very strong north westerley winds blown Wheelie bins and the small boxs that we put or recycled Plastic in. So I leave it ready for the binmen, who then empty it and put it back onto the narrow pavement and a storng wind takes it in to the path of a vechicle who is liable?? I have left it save and tiedie in my drive way before going to work???

This is a difficult question to answer in this day of health and safety regulations. If anyone was to make a claim from you for damages, then you should have insurance for third parties included with your normal insurance. However, if I was driving and hit your bin, I could be considered as not driving without due care and attention.

you are responsable for your bin before and after it has been emptied.

OK The bin doesnt belong to you it belongs to the Council therefore they are responsible for supplying you with unsafe goods.
The motorist is stuck because its also act of God for insurance.
You are NOT liable!!

Unfortunately you are.
Have had the argument about responsibility for bins on collection day.
The binmen will not empty your bin if you don`t remove it from your property & leave it on the street for them.
Even though the council insist you do this, they will not accept any responsibility for anything that happens because of or too your bin.
They are adamant that the bin is still your responsibility.
Had my bin stolen twice, got he same response twice.
Had to pay for replacement TWICE!

You are liable ,but you can ring your local council to ask them who would be to blame if a accident did happen .

i would imagine that the local council would be liable for negligence in their failure to secure the wheelie bin after emptying

YOU are liable. Wheelie Bins and Recycling Bins at all times are the responsibility of the residents of the house.

You are not liable, as someone can't say you should have brought it back in, because if you are like me, I leave for work at 7am, the binmen haven't arrived, and I'm home at 5pm.

Your still liable what ever way you put it im afriad. Its the bin mens job to empty it and put it back where they found it. It's up to you to bring it in so i doesn't blow away. If all else fails ask the council for the plastic large bags ones or put a few bricks in the bottom so it's not so light!
