Rear ended? who's fault?

ok so there was an accident involving a car stopped on a two lane highway waiting to turn onto a road on the left. They had their left turn signal on and they got rear ended. i got told that it was car stopped in the road's fault and not the person's who rear ended the others car fault. the explanation was that there's a law in florida saying that if a car is stopped in the road(even to turn) and a car is coming then the car that is turning should pull off the road. So my question...is this really a law? and who's fault was this accident

The person who ran into the back is at fault in any jurisdiction.

I've always known it to be the fault of whoever did the rear ending. If a car is stopped in the road to make a legal turn how are they going to pull off the road to get out of the other car's way? Whoever rear ended the car turning should have had the common knowledge to stop and wait for the car to turn.

I've never heard of that law. Most of the time it is the driver from behind at fault, but there are some exceptions as noted in the link below.

That's ridiculous. You're AUTOMATICALLY at fault if you rear end someone. The only remotely possible defenses are if the other car hit someone else (unnatural stop, and it's not accepted everywhere) or if they deliberately slam their brakes to make you hit them, which is fraud.

It doesn't sound like a law. It sounds like someone made that up. It doesn't make any sense and completely exonerates the person who hit the other vehicle. It doesn't sound right at all in any way.

I think the person that rear ended the other vehicle is at fault and worse they are stupid. You see a stopped car regardless - you stop - slow down. All drivers should avoid accidents as much as possible. It's called being a safe driver.

Some drivers are stupid. Don't be one of them. Because the person that said that is STUPID.

It's the fault of the car that ran into the other one.
The explanation you got was bogus. Where would the turning car go? To the right side? Too stupid to even be funny.
