The answer is D, and I will tell you why.

For A, suspensions are not automatic. The Police have to request you to submit a blood/urine/breath sample within a given time frame after you're arrested (in NY it's 2 hours). If they don't ask you within 2 hours - DMV will not suspend your license automatically. It can still be suspended, but that is only after trial is you're found guilty.

For B, this is not an invasion of privacy. When an individual signs for there driver's license, there is a proviso in the application that states something to the effect of "if you're ever arrested for driving while under the influence of alcohol or drugs that you will submit to a chemical test or else your license will be suspended pending revocation".

For C, you can have your own doctor perform a chemical test to determine your BAC, but & this is a big BUT - you CAN NOT put off or refuse the police officer in order to do this. You must submit to the officer's request or be suspended pending revocation.

You also can't refuse to take 1 type of chemical test in order to take another. For example, an officer asks you to submit to a breath test but you only agree to submit to a blood test. Also, you can't refuse to take a test because you don't have an attorney present. In these cases you do not have an absolute right to counsel - you can request to speak to an attorney but you can not do so to the point where the 2 hour time limit is about to lapse before you answer the question of whether or not you'll submit to the chemical test.
