Although it took me nearly five weeks to get notification of doing 77 in a 70 in South Wales...

There's Â£60 and 3 points right there... Which they very kindly offered to raise if I contested...

And although I'm sure the gentleman who suggested that you don't admit to anything has your best interests at heart... It doesn't seem to have done him much good (no offence - If you'll pardon the pun)

I'd just bite the bullet (if it ever happens) and take the points - One shining light at the end of the tunnel... I've been single-flashed a number of times and never received any notification, the only time I ever got the *bang-bang* was my three-pointer - Maybe the single flash is some kind of 'You're going a bit fast' warning..

Notification of a speeding fine usually comes through within a week.

I should advise you not to pay this fine but contest the issue in court.

This is England and under English Law you are innocent until proved guilty. In other words, the Fuzz, or whoever, have got to prove their case against you.

What does this mean exactly? What it means is that they must produce evidence in court to support a guilty verdict.
What evidence? In your case a photograph clearly showing the 'guilty' car and the number plate - and maybe even a shot of the wife's face.

I'm not sure of the procedure, but you should ask anyone sending you a notification of speeding that you want the phorographic evidence sent to you.

If no evidence is forthcoming, then you are NOT guilty and you do NOT pay any fine.

WARNING - not sure when this comes into force, but there's a Bill, either in the Commons now, or about to go on the statute books which means that a speeding driver will get 6 points [blimey] for first offence and another six second time which means lose lisence - not sure for how long, could be about six months or a year.

They have got to contact you within a fortnight, by law. If it's any longer you will not have to do anything! If they do get in touch with you, you have 28 days (I think) to reply. Near to the end of that time ask them to provide evidence ie, a photograph. Which then will give you another 28(?) days from there. When they return the photo ask them to produce a calibration certificate for the said camera. Then again it gives you more time to string the robbing b------s along and so on.

The flash and the image starts the process..
There is 6 months from the time of the image to get the offender to court and prosecute, outside of this is an abuse of process.
The NIP must be served on the Registered keeper of the vehicle within 14 days of the first flash and image.. you then have 28 days to reply, however. This NIP is an interview but without caution and though you must comply and send the details of the driver to the issueing office, again though as you've not been subject to"the caution" this is outside of PACE and you should inform them that the evidence you have given is inadmissible in court as it was obtained through duress and against your human rights.. It won't stop them from issueing a second NIP to the named driver but the SCP Safety Camera Partnership will now be obliged to send a police officer round to the Registered keepers address and interview them under caution, "you do not have to say anything and you are not obliged to answer any questions But if may harm your defence if you do not mention anything that you later rely on in court" If the keeper isn't the driver you can re itterate that you have provided the information under duress keeper and driver can both request you would like the interview to be under the advice of a solicitor, They then have to defer the interview until you have sought that advice.
The Driver is sent the NIP and process begins over again.
Once evidence is obtained, a summons will be issued to the driver, The driver then asks for full disclosure of evidence which includes both photos of the vehicle passing the speed camera and the markings on the road and the time day date location. You then take the car to the same location at the same position and try to obtain images that are representative of the photo taken, you also measure the markings on the road and the distance between them accurately. you then take the information provided by the images obtained the dirstance travelled and the time elapsed and calculate the vehicle speed. you also ask the SCP to provide details of when the camera nad the speed recording device were last serviced and calibrated and ask for the records as part of your disclosure ( failure to disclose this to you is an offence). Then take the package of information to your solicitor take your day at court and if you have calculated that you could feasably beat the system then go for it, otherwise now plead guilty and take the fine and the three points
