is it aloud by law that a speed camera can be in operation and set off a flash on speeding motorists on a duel carriageway with no street lighting and the camera not being visible to the motorist, Additional Details the speed camera position is not visible to the mortorist in any form or way,

They are usually noticeable by the motorist, at night time this will be by the large yellow reflective strip on them. Your headlights would illuminate it, just as they do to road signs.
If you are not exceeding the limit, then you shouldn't have a problem.
If you got flashed, then you only have yourself to blame.

"Visibility of fixed site enforcement cameras (including digital cameras)
All camera housings (existing and new) should be visible to road users and not hidden behind bridges, signs, trees or bushes. The minimum visibility distance should be 60 metres where the speed limit is 40 mph or less and 100 metres for all other limits."

There are no definite rules except that you should not be driving over the speed limit. Speed kills and if you drive correctly the speed cameras don't even come into the equation. |

Perfectly legal and they don't even need warning signs anymore. When cameras were operated under the camera partnerships, Police & local council basically. The council took a cut from the fines collected.
The government has changed the rules and all fines now go straight to the government so the rules about signs and only siting cameras within 3k of accident black spots went out of the window. |

Of course it's allowed by law, unfortunately ! The fact it's positioned on a dual carriageway with no street lighting, is irrelevant. The law states that providing motorists are warned, by permanently placed signs ( those rectangular ones with a black camera picture on a white background ) then it is legal and whether it's dark or whatever does not matter ! The cameras are a cash generator mate. |

Here are some of the rules governing the placement of speed cameras:
* At least 4 KSI per km in last three calendar years (not per annum)
* At least 8 PIA per km in last three calendar years
* Causation factors indicate that speeding was a contributory factor in some or all of the accidents – sites that are clearly not speed-related have been de-selected
* 85th percentile speed at least 10% above speed limit plus 2mph - i.e. 35mph in a 30 zone) for free-flowing traffic (excluding any rush-hour periods)
* At least 20% of drivers are exceeding the speed limit |
