i was stopped in the left lane during traffic on I-93. Police car was blocking lane i was in due to a broken down car. The car in front of me merges into right lane, traffic moves a little bit, traffic stops again. I look to the right lane and there was a mack truck stopped. Since i had plenty of room to merge, i put on my blinker and merge into lane. Once in lane mack truck rear ends me, but my insurance company is stating it is my fault? Ridiculous, not to mention that somehow a Nissan Maxima can do damage to a stopped 18 wheeler mack truck because that's what they are stating and the cost is absurd for a scratch on a mack truck when all i have is a broken case to my tail light worth $20 they tell me! i wouldn't have merged if i didn't have room and the truck was moving, but the truck was stopped, why would i want to get hit by a mack truck? Am i really at fault here?

If it is YOUR insurance company advising you are to blame, chances are you are to blame. Trust me, your insurance company has nothing to gain by accepting the fault of their client's (you) accident from the insurer of the Mack truck.
Answer # 1 is partially correct. However, the only problem with this case is that you were rear-ended while merging into another lane. For this reason, it is likely your fault.
*Tip - If there is next to no damage on the Mack truck and minimal damage on your vehicle, why don't you settle without the insurance companies? If this accident is documented as your fault, or any percentage thereof, your insurance premiums will go right up, regardless of how much damage was caused. Settling without the insurance companies will be SO much cheaper for you in the long run. Hope this helps. |

It is always the person who did the rear ending. They should have controlled their speed. If the MACK truck rear ended you, it is the trucks fault. Certainly the highway patrol would have written it up that way. |

Person who hit you is at fault. Last person to answer is completely right. Problem is fighting it might cost you more if you lose work and have to spend endless hours fighting in court. I probably would fight it just because I would be so angry and justice needs to be upheld. |
