I want to suspend a network cable across the road to my step dads house (we are in england). What are the legal and physical implications of this? Additional Details Would the best way be to fix some high tensile wire to each property and run the cable along this?

Different country here, but I can't imagine ANY community allowing this kind of activity without SOME kind of local planning commision, or equivilant's permission.
Think about the clearance needed for certain kinds of repair or rescue equipment to pass by on your roadway. |

You would definitely have to sling the cable from a steel wire that is securely attached at both ends. This is a standard requirement of BS7671 (IET Wiring Regs).
The cable must be at a minimum clearance height for that road. You won't be able to guess what that is because it may be on a designated diversion route for something else, but it is almost certainly going to be more than 5.03 metres.
The comment has already been made about Public Liability insurance. This is a real issue. If your wire fell onto someone then you would be in deeeeep shiiiitttt without it. You would have to pay the premiums for as long as the wire exists so that could be expensive. It's unlikely that you would get this insurance without Planning Permission which specified the approved standards for fitting it.
It will be a structure passing outside the boundaries of your property so you will definitely require planning permission. Again, this is because you have no way of knowing what covenants exist in your road which affect sight-lines, high structures etc., and you may affect future plans for overhead wiring by the Utilities.
It would only take one complaint, or even a harmless enquiry, by someone else in the road to set the Planners onto you. At that stage you're looking at courts and fines - and you would still have to remove your wire.
It would be dangerous and expensive for you to make any assumptions about any of that even if you think it unlikely that a high vehicle will use your road or that someone like BT will put up a telegraph pole.
Consider using a secure wireless system with directional aerials. It would be cheaper, simpler and safer. |

local planning office. they may advise you that you cannot suspend a network cable overhead, it has to be buried in a trench, like NTL, Virgin and others, he may apply for connection to the same network you are on, then it would be their problem to connect him |

The cost of doing so would make it utterly impractical.
You would need permission from your local authority and the Highways Agency to do so.
To get that permission, you would need to have a MINIMUM of £2,000,000 public liability insurance, in case the cable fell and injured someone.
To get that insurance, the cable and it's mounting points would need to be fitted by a professional company and licensed for use by Ofcom.
After all that, if any works department damages the cable, it's YOU that has to pay to get it replaced
Think in the region of £50,000 total to get the cable fitted legally.
If you don't do it that way, you are breaking the law. If you do what you are suggesting, you will end up in court. |

Check with your local council if there are by-laws preventing you from doing this. As far as I'm aware, so long as it doesn't obstruct the high-way (so vehicles can pass underneath) there should be no problems. If you're fixing the cable at roof height, you'll be well clear of traffic
As I said - check with your local council - just to be safe ! Otherwise - just do it !
as for the cable itself - so long as it's under 100m long, you should have no problems witht he connection - Just make sure you fix it FIRMLY to BOTH properties ! |
