Because you can't always see the phone. Same as the beer, but with beer you can actually check with a breathalizer. |

I think a lot of places are working very hard towards more severe punishment for that kind of thing. Here in Utah they are trying to pass a law that says talking on your cell phone while driving will be illegal, and I'm sure that includes texting.
It would be hard to prove that somebody was texting if they didn't see it, but they should issue a citation for the erratic and dangerous driving. |

I swear I seen someone that was drunk at 8 am today, but texting does make more sense. Haha |

in my country, drivers aren't supposed to use cell phone while driving. you could get fined! |

I'm amazed that you can not only drive better than someone in front of you that is distracted, yet you know exactly what they are doing in their car... most people would avoid them and if you feel the need, report it if it's that bad. Unless you are a judge or congressman, don't make laws for everyone else about driving. Drunk, soccer mom, asian, or whatever they are, if they can't drive they should be punished. Don't blame technology or stupid insignificant excuses for people that are bad driver's. Why should we all have to be punished? |

Anything that takes your attention away from the road is dangerous. Handheld phones are illegal in my state (CT). The punishment is not as harsh as drunk driving, but it's not a walk in the park either ($100 a pop!) |

Yeah my sister was texting while driving and crashed into some one and had her car written off!! Its soooooooo stupid and negligent i agree defo should be illegal xx |

I TOTALLY AGREE WITH YOU!! People that tend to almost crash into me or normally people that have their hands on their cellphone. |

Think about the evidence in a court of law. A breathalizer is an admissible piece of evidence. What, are you going to pull out a textalizer? |

it is illegal
but people will be people and do as they please
they'll think that nothing will happen..until one day something DOES happen |

I somewhat agree, but it's hard to see what drivers are doing inside of their cars, but if someone is driving like a drunk swerving all over the place, arresting those drivers would put a stop to texting while driving. And also cell phone records from the cell phone company would prove it.
Texting is more dangerous than talking on the cell phone. If traffic is stopped at a red light, then I don't see any harm of texting at that time. So, I think texting should only be illegal if the car is in motion. Talking on the cell phone should only be illegal if traffic is heavy or the weather is bad. It's common sense that doing either of these in bad traffic/weather is more unsafe than in light traffic/perfect conditions. |

in WA state it is illegal to text while driving, it is also illegal to use a cell phone while driving unless the car is equipped for hands free phone. I agree the penalties should be much stricter, |

This is one of those things that some people can do successfully, and some people can't. I think we have quite enough laws and excuses for the cops to stop and investigate you for doing nothing more than driving. We already have laws against swerving all over the place, just enforce those laws. Stay out of my car, and out of my phone. |

The Police should be allowed to pull MORONS caught driving and texting out of their car and TASER them on the spot. Fines aren't working; they need a little incentive. |

Yeah, I agree with you, but at least drunk drivers try to concentrate. They may not see correctly and their responses are delayed but at least they are looking at the road ahead. Texting and driving is just as bad, but even talking on your cell phone while driving is distracting you from the road. |

I've never been able to drive with two hands so I always have one hand free. I don't have to look at my phone to text someone so I can text and keep my eyes on the road. I don't do it if I'm on a busy street but if I'm on a straight dead road or stuck in bumper to bumper rush hour traffic, then it's really not a problem. I find it annoying that I can't text in places like CT. I drive through there quite a bit and I don't think texting in that kind of traffic would inhibit my driving very much. |
