This rear- end collision happened when I was coming out of a parallel street parking. I checked to the left to see if any cars were coming in or going out of the street. None were, so I felt that it was safe to move. I turned my car to the left, was going to reverse and then go out into the ongoing traffic. At this point, NO cars were going in or out of that street. Everything was clear. So my car was turned to the left, and I put my transmission lever to reverse, looked back and as I was going to reverse, this white car out of nowhere reversed back fast and collided her rear into my front bumper. The speed was about the speed when you dont press your brakes when reversing and the car is just moving. When the collision happened, my car was completely stopped and the other driver just reversed back. So this means that she didn't look back when she was reversing. If she had, then she would have seen me because the distance between my car and her car was pretty far. I know usually in a rear end accident, the person who was behind is at complete fault because they hit the car in the front. But IN MY CASE, I wasnt moving and the car in the front hit me.
Who's fault would this be??

also, we called the police to make a report but they said that they wont come unless a person was physically injured. So no police report was made and no independent witnesses either. Once pictures were taken by both drivers.

The other car for reversing into your car. If it was investigated by the police they would see by the tire marks that your car was stopped and hers was moving. |
