My friend was driving down a busy highway, and a pedestrian was trying to cross the 5 lane highway and wasn't in a crosswalk. My friend didn't see him, swerved, but still hit him. The man wasn't doing very good when they took him to the hospital.
We all feel really bad, but we are wondering what is going to happen. My friend wasn't drunk, or had anything to drink, which I know is good. They said it wasn't his fault. But we're still wondering what might happen? If the guy dies, can he be arrested for vehicular manslaughter?
Additional Details
The police came, took statements, and rushed the guy to the hospital. They said they would call him with more information.

The pedestrian was illegally crossing the road, and is totally at fault here. Your friend DID try to avoid the accident (which IS his responsibility, even if the other guy is being inept) so he should be not found at fault here. Your friend should not be found legally liable. |

it varies somewhat, but in most states if a vehicle hits a pedestrian, the vehicle is ALWAYS at fault. it may not 'be his fault', but it will legally be his responsibility...
actually as a result of that there used to be a group of people in FL that would intentionally walk out in front of cars to get bumped, then sue. they made a ton of money for a while in the late 70's through the 80's doing that. |

You stated 5 lane highway. If this were an interstate freeway [ex.I-95 or Interstate 241] your friend is not at fault. Pedestrians are not permitted here. If it were a state highway or local rd, then most likely the pedestrian is guilty of j-walking. This puts your friend not at fault again. Cross-walks are for a reason, and it sounds like the victim should have been using one. |

The law varies from place to place, without knowing WHERE this happend, you cant get a good answer.
Now in Las Vegas, the law is very clear, anybody not in a crosswalk is taking their life in their hands, if you hit somebody not in a crosswalk, you don't even get a ticket.
