My dad was driving home from work and a boy got hit while trying to beat the car. my dad tried to use the brakes and just the boy was also drunk what can happen to us? sued?

if the kid was DRUNK (now, let's not call him a kid anymore) it was his fault.....did DAD call the cops ? hope so.....I would institute a lawsuit against the "kid" and his parents....make sure that DAD claims he now has night terrors and can't sleep properly....he should also claim he is paranoid to drive now.....remember, he has to be the first with a lawsuit....much easier to be the aggressor than the defensiveman. |

Most US states have a law stating motor vehicle drivers have a duty to not hit pedestrians, bicyclists, horse riders, etc. Were there any witnesses that say your father had no chance to react? Otherwise, it may come down to who can afford the better lawyer. |

Nothing will happen, plus you could always counter sue the parents for damage to vehicle, parental neglect and stress caused to yourself.

I have a problem myself....I was driving on a 25mph st so I'm driving and a 9yr old child runs to the street ( but mind you she was j walking and in between two cars ) so I didn't see her and she runs to my car and got hit but on the side of my car not by the front of my car....we called the police and made a police report I told him how it happened and he saw her hand prints on the side so he said by hearing everything he is putting it on the report that she ran into me not that I ran and hit her...but my question is will It be considered my fault with the insurance or not? And can they sue me? By the way she is fine she only scrapped her elbow since she fell |
