Is this a hypothetical question?

The reason I ask is that a refusal to submit to a test is an automatic DUI and immediate arrest. I'm pretty sure that is true in all states.

It depends on which state and what their implied consent laws are. It is almost always true that for a first offense you will be better off taking the test and failing than refusing to take it. Refusal is almost always an automatic 6 month to 1 year suspension. Read the last paragraph in the link.

In the UK, refusal to provide a specimen of breath for analysis is considered an automatic fail and you would be subject to the same penalty.

Even though you refuse you will still be charged with DUI. And you will loose your license.
