A friend of mine was in an auto accident the other day. His Ford 150 Truck a 2008 was totaled. The thing is his air bags did not deploy, and his seat belt did not tighten up. His face hit the steering wheel. What can he do about this? Is there any kind of a class action suit on this? He called Ford, they were no help. Any ideas? Thanks

Actually, your friend could sue Ford for this. The thing is that Ford is responsible for their products that they make. They are responsible for making vehicles that work safely. That is why auto makers do tests to make sure that every feature is running accordingly and if they aren't then they are not to release the vehicle until all problems have been solved. If your air bag doesn't deploy and you are in an accident then that is the fault of the auto maker. Ford has had countless recalls on vehicles because of fault equipment or poor installation of products. Your friend should bring this up in a lawsuit because it is their fault, and he should not have to pay for their own neglect. Ford is responsible and should give him some compensation for a failed product. |

Some very incorrect information in some of these responses. An airbag deploys on the "deceleration" force against the car. It also depends on the angle of the impact. If your friend is serious about this, he should first speak to a mechanic familiar with his model vehicle and see if he can tell your friend if the airbag should have deployed. Your friend will need to hire an expert in this field, an accident reconstructionist and potentially a biomechanic if he wants to pursue this which is very expensive. An attorney may take the case and advance these costs. It doesn't cost anything to consult an attorney.
Ford has been sued for nondeployments and is currently in litigation in them so it is patently false that Ford can't be sued or that Ford has never lost. Most cases settle and no one can follow all of them. A sentence in an owners manual does absolutely nothing to absolve Ford of liability. I've cited a case against Mercedes below. I also cited another site that listed a failure to deploy case where Ford settled the case.
Now, here's the thing. The airbag deploying may actually cause more injuries than if it hadn't deployed. Therefore, in order to prevail, at a minimum, he needs to prove the airbags should have deployed but for a product defect in the vehicle and that he was actually injured. In a product liability case, it is usually irrelevant whether your friend was at fault for the accident but still must prove that the product was defective. An expert is required. |

Front airbags will only deploy in a front end collision, if your friend was rear ended the airbags would not have deployed. Side impact airbags only deploy in a collision on the same side the collision occurred on (driver side door is hit, driver door air bag deploys). This could be part of the reason they did not deploy. |

Nothing. Read the fine print on the sales contract and owners manual. There is NOTHING that states that the SRS (airbags) will deploy in an accident and nothing that states that passengers will not be injured if they do. If your friend is OK just be thankful for that. Forget suing Ford -- it's been tried lots of times, never successfully. They will trot out two dozen lawyers and fifty engineers if it should ever get to a courtroom. |

If the truck was not hit in the front and the brakes were not applied then your friend has no case against anyone but if the truck was hit from the front and the brakes were applied then Ford has to respond and talk with your friend.....You will need to speak with a lawyer for assistance. |

i would sue the hell out of them. fords do a good job at making truck/car/suvs. my pap got a 07 f150 not to long ago and its all around a good truck. my boss has 3 ford trucks for his landscape co and we beat the snot out of them. and they still run like new. i would tell them you give me 2 free trucks of my choice and i will not sue you. |

Sue them if it was a bad enough accident to total the truck then the air bags should have gone off. That's why you don't buy a ford you have to
