Whats the law on disabled parking spaces

my mums neighbour has a disabled badge but because of an op couldnt drive so the bay was unused (this bay was actually put there for my father who died 5yrs ago) she now has another car because of the limited car parking spaces people have been using this space she has now threatened my mother with the police because she had parked in this space for 5 mins whilst she unpacked her shopping one of the other neighbours have told us this parking bay was a courtesy bay and she has no right to be threatening people i want to no if this is the case shes a naturally agressive person and i dont want any trouble but this has quite upset my mother could some one tell me where we would stand on this

although the bay was originally for your father who l presume held the blue badge, it can be used by any other disabled driver providing that the driver is also a disabled driver with the blue badge entitlement. the way you have posed your question, l can take it that your mum is not a blue badge holder, hence she should not have parked in the bay.if the bay was originally provided for disabled drivers to park in, then it will still be for that purpose and that purpose only, if the council withdrew the bay it would have taken away completely. your neighbour has a right to moan about you parking in it if you have not not got that blue badge entitlement. but she should not be so possessive as the bay is not solely for her use alone.

The best thing you can do is contact the council & tell them you don't need a disabled parking space any more as your father's passed away.

You are not allowed to park on them without a disabled badge , if you do you can be towed away and fined

If the space is a registered space outside your house then it is there at the discretion of the local authority and can be used by anyone who has a Blue Badge as they are not reserved for any one person although it is usual for people to be reasonable as to the usage by the resident. It should not be used by non badge holders in the same way that disabled parking bays in car parks are abused by able bodied people who are very selfish and do not understand the difficulties by some of us disabled people in walking any distance. Unfortunately the enforcement of the rules is very hit and miss as the local enforcers often do not have much sympathy with the problem and they do not understand the rules themselves.
Your Mother ought to ensure that if she has a Blue Badge that the space is registered in her name otherwise she has no rights whatsoever and is considered to be an abuser of the privilege granted to disabled people.

If you do not have a disabled plate or placard then you can not park in a marked spot for a second.

Your neighbour should be ashamed, your mum was only parked for 5 minutes. The police wouldn't entertain the nasty lady.

Where I am from any disable parking space is to be used by only a person with a disabled plate and or window tag and no one else can use it............

Go to your local town hall ask in the office that issues the disabled drivers permits and allocates spaces,they will give you all the correct information in force in your area.Good luck.However ,if you do not have a disabled drivers permit then you must not put your car on or in that space,even if your front bumper is overhanging the white line you will be prosecuted.If your disabled neighbour does not have a permit for that space she also will be prosecuted.
