i was backing out of my apt into an alley, and a car stop and hits my car and a pole. (other car going to fast) who is @ fault?
Additional Details
_____other person did admit to being in a rush to get to work. and she meantion it wasn't the first time in hitting someone in the alley

Generally this would be considered your fault. You would need to show that the other car was traveling excessively fast for it to be their fault. |

A driver in the process of backing up never has the right of way. But if you started backing, saw the car approaching and then stopped, your vehicle would not be in motion and therefore the driver of vehicle strikling yours would be at fault.
It is hard to prove either way. Look for some witnesses. |

Your fault. You were backing out into the roadway when it wasn't safe to do so. It doesn't matter how fast the other car was going. |

In most situations, it is the driver of the car backing up who has the responsibility to make sure the way is clear. The other driver's speed may have contributed to the collision, but it would still, primarily, your "fault."
By the way, the fact that it wasn't her first time this occured would have NOTHING to do with it. |

Probably your fault. Cars exiting driveways must yield to (wait for) cars already on the street before entering it. |

I agree. Your fault. Unless this person was driving above "alley" speed limits, then you might have a case. But that can't be proved cuz it'll be word against word. Peace out. |

Yours cause you should have looked both ways before backing out. She may have been in a rush, but she still had the right away. |

Its your fault for not maintaining control over your vehicle, 99.9 percent of the time the person that is reversing will be at fault. |

IF you were doing it carefully and the other driver was going too fast then there's, but if you came straight out infront of them well obviously yours also DON'T ACCEPT RESPONSIBILTY AT THE SCENE, CAUSE THE DAMAGE THAT WOULD HAVE COST A £30 TO FIX CAN SOON CHANGE INTO £3000 DAMAGES, OR A RIGHT OFF!! |
