Who's at fault when someone is in the median & turns onto the highway then have a car rear end them?

Ok, whos at fault when a driver is on the median (middle)(waiting for ongoing traffic) and drives on to the highway because the lane was clear at the moment and then suddenly get hit from behind by another driver? (The driver that was on the median had turned and was on the highway road for atleast 5-10 feet) Would it be the drivers fault or the rear-enders fault??

The person in the median would be at fault.

your not suppose to use the median for u-turns....5-10 feet, you need to get a faster car if your going to be pulling out in front of people, your fault...........

Most of the time, the car that rear ended the other car will be at fault. But many times, in situations like that, there will be an investigation to see if the person on the highway attempted to avoid the crash, etc.

We have a lot of problems with that with 'Michigan Lefts' all over the place.

It's also a problem in roundabouts, but many times the person who got hit will be charged with failure to yield for oncoming traffic.

Only authorized vehicles can be in the median. In the situation you describe, the motorist pulling out would be at fault for a couple of reasons: (1) He was in the median illegally, most likely and (2) He failed to yield

It sounds like the driver who pulled into traffic was at fault.Maybe they just didn't see the oncoming car.In Florida if some one is rear ended they go by a percentage of who is at fault.

almost everywhere if you run into the back of someone for any reason it's your fault....never mind that the ******** idiot didn't look before they pulled out into the road....it still is going to be your fault if you into the back of them

The rule of thumb is that it's always the person behind's fault. However, if you were provable there was no time to respond the rear-ended might be held responsible.
