Who's fault is it?

Two cars, one fails to signal, and proceeds to change lanes. While moving into the left lane, car "cuts" the car off he is trying to get in front of, causing the car who was cut off to run off the road. While being run off the road, car clips other car's bumper. So, the cars made contact rear driver side corner (FRONT CAR) and front passenger side corner (car run off the road) In NJ, a rearend collision is fault of the car who does the hitting. Who's fault is the accident?
Additional Details
One car was in the left lane (car run off the road) and the other car was in the center lane (car that went into lane without signaling) sorry, hope that helps.

I have to agree with S.S. Blondie. The car that makes contact (rear) would be at fault in an undisputed case. I would fight this if I were *ahem* the rear car, and perhaps the penalties will be reduced or removed. Unfortunately, don't hold your breath.

I would say it would be the car that didn't signal when changing lanes and cut the other car off.

proof of failure to signal, by other witness would help,
side swiping in a blind spot, car behind should be more aware,
cars that make contact, best be dealt with through insurance,
if no major damage is done

The car who hits the other car! Doesn't matter if you get run off the road or not. Of course, if you get the tag number of the reckless driver it will bear a lot of weight when the police catch up with the driver but otherwise the law states you must be in control of your vehicle at all times! PERIOD!
The insurance company will fault the driver of the car that "hit" the other car!

generally speaking, the car who made contact (rear car) is at fault. take him to court. did you get a ticket for "following to closely"? i would fight this one.

I know it stinks in a situation like you described, but I believe in all states the car who strikes from behind is at fault. The reason being that you were not following the car in front of you at a safe distance (3-5 car lengths). Sorry!

i would think it would be the person who didn't give a turn signal. you should always signal when your changing lanes.
