Who's fault is it when someone hits a dog at a park? ?

The speed limit is 25. They left skid marks for about 8 feet trying to stop, so speed was a factor. However my dog should have been on a leash too. Who's fault is it? Just curious about this. Someone told me that if a vehicle hits an object, it is always the driver's fault (this does not include other cars and drivers, but only includes objects or items like dogs, bikes, etc).

in my opinion it is the dog owners fault. The dog needed to be on leash for many reasons. 8 feet of skid marks doesn't mean "speed was a factor" any more than the make-model of car or the drivers hair color. fortunate it was just the dog getting hit and not an off leash dog biting a kid or getting into a fight.
The driver wasn't obviously speeding with 8 ' of skid marks.

take responsibility, you were supposed to know better than the dog, don't just pass the blame to someone else

its 50 50, because the person who had the dog was suppose to watch him and he was going above the speed limit

Actually it is both you and the driver's fault. The driver is at fault because they obviously were speeding if they hit the dog as you say. And the fact that they left a large skid mark distance then that says they were breaking the law by exceeding the speed limit. So if they were going slower then they would have reacted at a quicker response sparing the dog from injury. I also say it is your fault because you should have had the dog on the leash. It is the owner's responsibility to keep the dog in a restraint which decreases the chance of an injury or lawsuit. So both of you are at fault for this one.
