Who has the right away in the parking lot?

Who has the right away in the parking lot?

I was parked in a parking lot. The cars parked rear outward. My car and another car started backing out at the same time. We both hit each other. Who's fault is it? We got out of the car the other party did not get out. We looked at the bumper of our car and no dent and the other car pulled away. I wrote down the license plate. Who is at fault?

The most difficult maneuver in a car is backing out. Since you said you bumped into each other. Then, you were both at fault. The better arrangement is one car should wait for the other car to back out first. Anyway, since there was no damage, you can just charge this to experience. Next time, you assume the defensive driving technic of waiting. There is no sense in hurrying up, especially in backing out. As expected, accidents like this happen when you disregard common sense in driving.

First, note that "right of way" (not "right away") doesn't exist until one driver yields it to another driver -- it can't be taken, only given.

second, both cars backing up, you are each at fault for your own damage, but it's a moot point in this case -- no harm no foul. If your car wasn't damaged then you don't need their license number.

it is both of your fault 50/50. you have to pay attention while backing up. you can report the other driver for hit and run.

You can report the other driver for hit and run but there really is not reason to if no damage was done. You are both at fault. There really is not right of way in that situation. You just have to use good judgement.

Even if you had received damage from the hit the police will not come to the scene of a accident in a private parking lot unless there is a suspected intoxicated driver, someone is hurt, or if the hit was done in an attempt to harm someone on purpose.

If you hit each other, you are both at fault.

You're both at fault.
You mutually contributed to the accident.

Give way to the old timer having trouble manouvering and the mother preoccupied with her restless kids and you will avoid a lot of trouble.
Sounds like your bump was a 50/50, no damage done, forget it.

Report 'em for hit and run. Be careful! (with the case and driving)
