i was at giant eagle today and i was backing out to the left in the parking spot and when i was almost out an suv smashed my left rear door. they were backing out from the other side trying to go the same direction ( meaning had we not hit wed both be going the same way after we start driving away). who is at fault in this situation because i dont think its mine at all. its my car that got hit and got all the damage. and since the direction we both wanted to drive was on my side id say that also gives me the right of way. everyone please give me all the input u can and should i be talking to my insurance and have them argue it with her insurance?

Well first thing you should of done is called the cops atleast then they could of assessed the situation in which the accident occured and on the statement it should say who was at fault. Most likely in that situation if it was considered both your faults which would be considered a no fault situation because both your actions cancel the other persons out. Then your insurance company would pretty much pay for your vehicle and there insurance company for the other being that it wasnt just the one persons fault

You both were. Neither of you were paying attention, because if you were, 90% chance you could have avoided it from happening. But it is the other car's responsibility to pay.

Yes have the insurance companies battle it out but this will be a 50 / 50 fault.
