Who is to blame??????

If your driving on a road and the person in front of you stops because they missed the address they were going to stop at and you drop your water bottle causing you not to pay attention to the car stopped in the middle of the road and hit them WHOSE FAULT IS IT?

It is your fault: the specific charge is "Failed to stop within the assured Clear stopping distance"

This translates to failing to stop without striking any vehicle or object which is stopped or moving slowly in your traffic lane without leaving your traffic lane... regardless of weather and road condition - To wit if you crest a hill at 10 MPH on an icy road and a tree is down across the road and you hit it ... it is your FAULT! Stop trying to find an excuse ... You were the driver and you are responsible. Darn right you are responsible for avoiding another car stopped for any reason in the middle of the road.

well it would more be the 2nd persons fault because they lost their concentration and if they wasn't worried about a stupid water bottle then the accident could have been avoided but also the 1st person shouldn't stop in the middle of the road either so they both did something stupid, but by law the 2nd person would have been "at fault" to the cops and insurance

It doesn't seem right, but you are at fault for hitting them even though they were stopped. You are required to maintain 100% control of your vehicle at all times. If you had used the "safe following distance" rule, this accident would have been avoided. If a Schoolbus stops in the road, you don't get to hit IT.

Cars sometimes must stop in the middle of the road for a variety of reasons, such as because there are animals crossing the road. You much watch for stopped cars at all times.

What is NOT legal is not paying attention when you are driving.

It's considered following too close and it's your fault. It stinks but that's the law.

You are at fault. You were not paying attention to the driver in front of you. HAD you paid attention, you could have stopped in time to avoid the accident.

The reason also is that you sound like you were tailgating. Tailgating does not allow you enough time to stop for emergencies. A good driver is a defensive driver, always assuming that the other drivers may do something careless.

The other car stopping in the middle of the road is irrelevant to the law. YOU were not paying attention. You were distracted. And when you get your insurance claim back you'll see that you were deemed at fault.

Water bottle dropper is to blame. Eyes should always be on the road, and the driver should allow enough distance to stop safely if the driver ahead of them slams on the brakes.

The other driver was careless for stopping in the middle of the road because they missed an address. The proper thing to do was to go turn around and go back and not stop in the middle of the road with a car behind them. Some people are stupid. But since the car from behind was probably following too close, they are at fault. A driver from behind is suppose to be prepared for a sudden stop of the car ahead. As far if it's legal for a car to stop in the middle of the road, I don't know, but people can stop to let animals cross the road, etc. Let the insurance company handle this and don't admit fault, but the insurance company would probably find the car from behind at fault. But I would say this, I've heard that insurance companies look at to see if accidents are avoidable or not and avoidable accidents are considered chargeable accidents for the driver (by the insurance company, not on the driving record). Since the car ahead could have avoided the accident by not stopping in the road, that driver may get an increase in insurance rates. And the car from behind too because it wasn't keeping proper distance. I've heard that just because a driver is not at fault for an accident, there insurance may still go up if they believe the driver could have avoided it. So, it's important to drive defensively.

yours. you should never be closer than one car's length per 10 mph allowed by the speed limit, to the car in front of you... e.g. if the speed limit is 65 mph, then you should never be closer than 6 and 1/2 car lengths' from the car in front of you.

Uhh yea I think it would be part of the person who passed the address, he/she can't just stop in the middle of the road without any type of signal or something. Then you have to keep your eyes on the road. LOL. If that happened to me I would blame it on the address person. xD.
