Whos at fault?

If you are driving in the right lane of a 6 lane road and someone cuts right directly in front of you and immediately slams on their brakes to make a right turn and you rear end them, are you still at fault? Even if you slammed on your brakes as hard as you could as soon as you saw the other car coming into your lane?

Those that say that the car in back is at fault every time in a rear end collision *are wrong*. Some even say it's 'the law'. There is no law anywhere that says this.

There are laws that talk about following distances, and that you have to keep enough distance between you and the lead car to avoid an accident.

Fault is usually measured as a percentage. When the insurance company looks at the accident reports and your car they determine by what percentage you're at fault. If you just hit someone in front of you, they'll probably place you at 100% fault.

But if 'someone cuts right directly in front of you and immediately slams on their brakes to make a right turn and you rear end them', and the ins co sees this from the accident reports they'll probably say the other party is 90% at fault.

Most people on here are wrong. GENERALLY, if you rear end another vehicle, then you are at fault. Not in this case. This happened to a friend of mine while he was riding his motorcycle. The other driver was found at fault and had to pay. The problem is, it will be hard to prove that he cut in front of you and slammed on his brakes without any witnesses. Good luck, though.

It's the other driver's fault, but it very hard to prove unless you have other eye witnesses that are impartial.

The thing that stinks is that you are at fault, sorry thats the law

but there is some sun that shines out of the sky if you have a witness =) then maybe you can bring them to court or whatever happens

You are at fault . Sorry but that is the law, if you rear-end someone then it is always your fault unless you have someone that can backup your story

Whenever you are involved in a collision and strike the other vehicle from behind, you are driving too fast for the road conditions.

The fact that the other driver made an unsafe lane change would weigh heavily as to the comparable negligence of each driver and that unsafe lane change should be brought to the attention of the investigators and trier of fact (should the case go to trial).
