I was at the intersection on a red light, when it turned green I drove straight and as I was going a car on my left hand side made a left turn into my line hitting my car on the back of the left side of the car. He claimed that he had a protected left turn when he made the turn. But when I stop on the side half a dozen cars behind me passed us. Also I later checked that intersection, when his green arrow come up it is also green for for the cars going straight in his direction. Additional Details I made a pic of what happened because my explaination was a little confusing

the left turner was at fault. they are required to yeild to all traffic. i have yet to see a green arrow clearing a left turn when oncoming traffic has a green light.....and there's enough lights with arrows around in warren to know this fact. all thru traffic has right of way. left turners have to yeild. consider urself lucky u wasnt on a bike...u'd be either dead or in the hospital; and the ****** is....all he'd get out of it is a failure to yeild instead of vehicular homicide for takin u down. |

There are some lights where it'll be green and have a green arrow for one direction only. Then the left-turn arrow will go red, and then the light will turn green for opposing traffic.
He might have just missed his light and decided to go through anyway. |

For him to have a green arrow it can only mean:
1. It's a protected turn (which means you ran the red light)
2. There should be a sign that says "left on green after yield"
Dont' worry about what he says. File on his insurance and stick to your story. Insurance companies are good at getting to the truth of the matter; there are timing issues involved with lights that the general public doesn't know about that they can find out. |

Were there witnesses? I was involved in a similar situation where the light turned yellow and a guy made a left in front of me and I hit him. He said it was my fault but there were witnesses that gave statements saying he was at fault. Also, if you fight it hard enough I would think that there is a way to find out what the programmed pattern for that intersection is. |

The car making the turn was at fault. Even if he had a green arrow, he was still responsible for completing the turn without causing an accident. |

He is wrong, the person one the right always has the right of way. The city is also wrong in the control of the light. It needs to be reported before some one get badly hurt or killed. |

I'm trying to picture the scenario.
Were you both facing the same direction, BEFORE either of you lights turned green? If so, it is possible that the lights were functioning and all traffic, coming from the same direction, had green lights, some to go straight, and some to turn left. In that case, it is possible that his car strayed into your lane before he turned left.
If he was coming from any other direction, and it is true that you both had green lights, then the signals were malfunctioning and the city is at fault. Go back to the intersection with a friend and see if you can catch the lights during a malfunction. If you find this is so, your friend can testify on your behalf, in court. Neither you, nor your insurance company should have to pay for any damages.
Otherwise, in court, it will be determined that, at least, ONE of the two drivers was lying, and, unless you can produce witnesses to the collision, it will be your word against the other driver's. |

he may have had a green arrow but that does not give hime the right to turn into you. it is possible that his green light says
ok to turn but yield to on coming cars |

Tough call. I would say the turning driver was in the wrong lane if there was more than one.otherwise the light is malfunctioning. the state and sometimes the city are to maintain lights |

blame it on the constitution. When will we pass a law that prevents those dangerous left turns on STRAIGHT green lights . People who do that tend to pull into the middle of the intersection and take a chance. They are "SUPPOSE" to only turn on the "green straight" if the path is clear and "suppose" to wait and yield to oncoming traffic. I'd say you are right, but you should have had recorded witnesses so you have backup to take that fool to court.
Lesson number one in defensive driving...wait 2-3seconds before pulling out at the green light and ignore those fools behind you honking horns on their way to the golf course. |

if you both had green lights, then it is the citys fault... lights do malfunction... that is why when going through an intersection, you should watch the other drivers and proceed slowly!! |

Did the police come to the accident, they usually will determine fault. I would tell the city about this problem so they could address it. That seems very dangerous and scary. It could be a malfunction in the traffic signal there. |

first of all, you were not at a green you were stopped at a red light and 2nd of all, how would someone hit the rear side of your car while turning? you are more at fault because you should have seen him especially if you were stopped and there was no front end damage. Are you saying all of a sudden the other car started turning and was going faster after you were already proceeding? Please tell me how you checked the intersection and claim that both traffic directions have green lights at the same time, my god there should be accidents every minute. |
