Whose at fault in this traffic incident?

If a car on the opposite side of the street is making a abrupt left handed turn, and you t-bone the car because you can't swirl out of the way. You are going at the speed limits, 40 mph. Whose at fault?

The vehicle turning left would be at fault. Any traffic that has to cross the flow of traffic must yield right-of-way on any intersection that is not controlled by a traffic control device or sign. If they were in an intersection that gave them a green left turn arrow, and it was lit, then they would have the right-of-way and if hit broadside, then the other vehicle would've been at fault. (Most likely for running a red light)

If someone in an oncoming lane makes a left hand turn directly in front of you of course you are going to T-bone them. Physics says you can't do anything else. And they are completely at fault because they left their lane. If you had swerved to miss them and hit another car, you would have been at fault because you left your lane. But that's not what happened here.

Without a doubt the one who turned in front of you.. but... as in many states no-fault laws get in the way.

It is called the right of way, and/or impeding the flow of traffic. Whenever someone is 'crossing' the flow of traffic, they are to yield to the right of way, of that flow of traffic. Obviously in your description, it is no secret that the person turning 'left' is crossing the flow of traffic. Now, EVEN...had this person even been making a right hand turn, not crossing 'over' any lanes still just joining in.... on that right handed lane, continuing in to the flow of traffic, a car is coming in the same direction that they are turning Right on, onto the street...STILL, IF they caused the person going down that right hand lane to hit them in the rear, pulling out abruptly in front of them, etc...of that already traveling vehicle, they too, still would be impeding the flow of traffic and be sighted.. EVEN though they were hit in the rear of their vehicle, some don't think this...they are wrong. Not always being hit in the rear of your vehicle, automatically deems the person that hit you at fault...(as usually they are coming from a street that has a stop sign). Whenever you have a stop sign, and the adjacent road does not, that road, that direction, etc. has the right of way, period.

So, think of a cross, up is North, down is South, to the Right is East, to the left is West. I am going North and you are traveling South. You need to turn Left, now heading East, therefore crossing my path, so you are to yield to me, period.

If it is an uncontrolled intersection, the car that turned into your path is at fault. You had the "right of way".

In Ontario no one is at fault. We have n0-fault insurance. Both parties lose points and their rates go up. The police are only to be called if someone is injured.

PS:
You are suppose to leave one car length between each car for each 10 mph. You are also to drive defensively. I bet both parties would be at fault.

not yours you have the right of way and he turned into oncoming traffic same thing happened to me and i got payed pretty good hope you said you were injured and got an attorney

it depends on where you hit them, if you hit the front half of their car its their fault but if you hit the back half of their car i think it would be your fault cuz you should have been able to stop in time ( unless driving conditions were bad but then you should be doing less than the speed limit)

You should always be able to stop or turn. Observing cars ahead of you (was he signalling, were his turn lights on?) is part of that.

If he was speeding and flew into right in front of you, maybe you would have a case, but especially when approaching an intersection you are expected to be cautious and in control. Tboning someone in an intersection is looked at kind of like rear-ending another car... if he had turned into you, his fault. You ran into him, your fault. Not always fair, but how they tend to judge it.

if u cant swirl out of the way then no ones but since u hit them its ur insurance u should just stop
