Why was I fined, when my sister and her two kids of her were sitting in the back and were unbuckled?

Where is the justice served, my crime was that when my sister got into the car, in the back seat, her two kidz were buckled, but some where along the way they removed their seatbelts and exchanged seats and didn't strap themselves in. Do I have to be punished for their indiscipline when both their parents were present. Their dad, my brother in law was sitting in the front seat. I have been penalised monetarily and with six points on my license.

hello, their mom was sitting with them in the back seat, dso you expect me to turn while driving and see what is happening in the back? There is no warning that comes on, on the dashboard saying the seatbelts of the passengers are not on.

Well, where do you think the buck should stop? As the driver most jurisdictions point the responsibility to the driver which in this case seems to be you. Hopefully the parents can help you out monetarily as it seems between you guys its their fault.
But just like a captain of a sinking ship, the CEO of Enron, a failed leader, even though the problem might not be directly their responsibility they get the final hit. So you like them get the hit. I would suggest you don't give rides to these people anymore unless they make restitution. Be careful, not to get to many more points as that can be a real bummer for awhile. Good luck Hmmmm

The driver of a vehicle is responsible for the actions of all occupants of the vehicle; open alcohol containers,trash out the window,obscene hand gestures,seat-belts etc,etc.

Who was the driver? Who was the captain of the ship? It is called responsibilities. Welcome to adulthood.
You are actually lucky that you were not in an accident. If your car was hit by a drunk driver, YOU could have also been held for involuntary manslaughter.

some states require people in the rear to be buckled but where i live there is no backseat seatbelt law.

When you are operating "driving" any car weather it belongs to you or anyone else....you are responsible for everyone in that car...that means..child seats, seat belts, littering, etc...anything that goes on in that car is your responsibility....just like a bus driver is responsible for their passengers....a teacher for their students.....an a parent for their children ...but because both parents where present...with the children...but you where driving...you where responsible for the parents and children because you had control of the car.....

think of this...if you had wrecked and the children had been killed...you would be held accountable for that..... IE involuntary manslaughter.....think about it....

Yes you are the operator of the vehicle, you run the show. Same way it works for a 16 year old girl when her girlfriends are in teh car. They are all required to buckle up. They could have all been adults and it still would be your fine. I always make my passengers buckle even if only for this reason. I agree though it is unfair in your case... those parents need to pay you. I would flat out ask them to pay the fines.

Because you were driving you have to pay the penalty but I would suggest they pay the price of the ticket, that would be only fair.

As the driver of the vehicle, you're ultimately responsible for the safety of everyone in your vehicle. I would take this as a hard lesson learned and insist that from here on out, everyone buckle up and stay that way.

Unfortunately, the driver is responsible for everything in the car. If someone brought drugs into your car, placed them somewhere in the car, and you got pulled over, you would go to jail for the drugs. You could try to fight it in court, or you could take a driver improvement class to remove the points. You can find some at www.AmericanSafetyCouncil.com or www.safemotorist.com. I would have your sister pay for the monetary penalties, though, considering that's the least she could do. Hope this helps and good luck.

As the operator of the car, you are responsible for seeing to it that all pertinent motor vehicle laws are obeyed. Chalk it up to experience and pay closer attention next time when you have passengers. It's a big responsibility.

It would be "big" of your sister and brother-in-law if they at least offered to pay all or part of your fine for you. In addition, have a plan of action for the next time you are their chauffeur.

that hurts but next time cops stop you you yell to every one in the car put you seat belts on if they have them on theyll respond as such if they dont they better scramble
