If it was done deliberately, or through sheer carelessness, I would take a good look at the person driving if I was the examiner. This may sound trivial and comic, but its actually illegal as others have pointed out, it constitutes assault, and besides is extremely discourteous to others.

If is seemed genuinely unintentional and was the only error on the test, then no I don't think I would fail them.

Splashing people on the pavement by driving through puddles is classed as Driving without due care and attention or Driving without reasonable consideration for other road users. It is an offence punishable by having 3-9 points added to your driving license.

The people splashed or any witnesses could have reported the event (that includes the instructer) and the learner could have points added to the license that would stay on if and when a full license is obtained.

You can also be liable for compensation claims by the victims for damage to clothing and possibly more expense if they were on their way to an event for which they'd paid but had to cancel.

As a driver it is your responsibility to watch the road ahead for hazards and react accordingly, which in this case would be driving around the puddle, or driving through it slowly so as not to splash people on the pavement.

YES, I would immediately fail them. The examiner should have kicked the person out of the car and made him/her walk back to the Examination Centre.

It is a Criminal Offense in it's own right, and also the person concerned was driving without due care and attention.

As a professional examiner you would have no choice. It is causing distress to other road users.

I would be a bit surprised if they managed to splash a pedestrian while NOT driving through a puddle

I saw this story and I think it´s crazy and unfair to fail somebody for splashing, especially as it´s not something that is specifically in the highway code or that you are told in driving school.

i would be professional about it and look at other aspects of that persons driving and if there driving was lacking throughout the day or was it just that one mistake?
