Nope you are not responsible. He should not have been on the road in the first place. You got lucky. Sweetie these people are not reading your question. They are just talking about if you hit him from behind and he had a license. If he was driving on a suspended license he is at fault because he should not have been on the road if he was obeying the law. I am a paralegal and if those people would read questions instead of answering just for the heck of answering they would understand your question. Your insurance will still go up regardless if you go to court you will not be at fault.

99% of the time, if you hit someone in the backend, your at fault regardless.
He could have been stoned out of his mind. It would still be your fault.

Yes. I don't know what country you are from, as laws may differ, but certainly in England and Australia (and most probably most other countries) if you hit a car from behind then it is always your fault.

The reason for this is that you should always maintain sufficient distance between your car and the car in front to be able to brake in time to stop without a collision.

The fact that his license was supended is irrelevant. It wouldn't matter if he was a convicted murderer driving a stolen car with a hostage in the back - the accident was your fault.

yes.. omg you should feel horrible. lol. no. not to me.. they shouldnt have been driving in the first place. even if the wreck is your fault.... not your fault for that person being arrested.

Regardless he has a license or not, like you said, you hit him from behind. You are msot likely at fault. He is driving without a license or no license at all, it doesn't matter. The law is on his side. He will have to face the judge about driving without a valid license. His insurance company or himself will file a claim against your insurance company. All I can say, it is just bad luck. Art the least you are still alive and not physically harm another person. Just learn from it...

Yes, you are still responsible. Whether the other person has a license or not you failed to maintain a safe distance between the vehicles. Or you may be cited for failure to yield or stop for an enabled vehicle.

It's you fault if you EVER rear end another vehicle. His arrest has nothing to do with your negligence of not paying attention of what was in front of you. He was just in the wrong place at the wrong time to get arrested, but you are still at fault.

Regardless of whether he had a driver's license or not the fact remains that you hit him. Of course you're at fault silly. If he'd had the license you'd be at fault wouldn't you? Be more careful next time and stop looking to shift the blame for you're bad driving.

Yep, if you hit him and its your fault, then your responsible for the damages. The accident did not happen just because he didn't have a valid lisence.

Honestly though, how would you feel if the tables were turned? If you were driving with a suspended lisense and somebody smacked into your car, wouldn't you want them to pay up?

yep. in ohio, u will get tagged for assured clear distance at the very least. or u will also get failure to control tacked on. u are required to have a valid license at all times on the road. if its suspended or expired for even a day, u'll get hit for no license/suspended license. get ready for higher insurance rates.

If you came to a stop at a light or sign at a reasonable rate then you did absolutely nothing wrong. If you came to a stop at a reasonable rate for a turn after you hit your blinker a ways ways back then you did nothing wrong.

if he was arrested then no you are not at fault because he shouldnt been drivin in the first place most likely but the accident will be on your record the only one that can answer that is the police dept you dealt with..he didnt have a license so thats where the accident would be his fault cause he shouldnt of been on the road in the first place....
